Government & Public Law

Public-law enquiries often begin with a decision, notice, assessment or proposed exercise of power by an agency. Identify the decision-maker and get the whole decision record together. A general sense that a result is unfair does not identify the legal route for challenging it.

General information only — not legal advice. This Australian overview is not a statement of every state or territory’s law. Check the jurisdiction and current requirements with an appropriately qualified adviser.

How these legal topics fit together

Internal reconsideration, merits review, judicial review and a complaint to an oversight body serve different purposes. Not every agency decision can go to the same tribunal. Disability, social security, professional registration and education matters may have their own decision and review systems.

Prepare your enquiry

Record when and how the decision was received, what reasons were given and which review information accompanied it. Ask about the available remedy and timing promptly. Explain any communication or accessibility support needed so the advice process can be arranged appropriately.

Questions to define the work

  • What decision can be reviewed and by whom?
  • What remedy could that process actually provide?
  • Does requesting reasons or making a complaint affect any separate deadline?

Official resources and their scope

Use these primary resources for background and current pathways. A state-specific resource is an example for that jurisdiction, not a rule for all Australia. Broad regulator and tribunal links do not establish your eligibility or a legal entitlement.

Our document lists, questions and examples are original editorial preparation prompts. Follow the relevant authority for current requirements and seek individual advice before acting.
